MS FTP Arbitrary Code Execution vulnerability (MS09-053)

I am managing a server of a corporate house who have outsourced the security management to a third company who scans the server periodically using a vulnerability check tool and submits a report. From the past one month, their tool is detecting MS FTP Arbitrary Code Execution vulnerability (MS09-053) though I have installed the patch which is available on the Microsoft website. Still the vulnerability is detected by their tool. I think it is a problem with their scanning tool, but I am not able prove it. Is there any tool available which can scan the server and show the vulnerability is patched?
